Terms of Use

These Terms of Use (the "Terms") constitute a legally binding agreement between you and Horizon Solar Group LLC (dba Tangelo Leads) ("Tangelo Leads," "we," "us," or "our") governing your access to and use of our websites, pages, forms, services, communications, and related content or features (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Services.
Eligibility and Intended Audience
You represent that you are at least eighteen (18) years of age and have legal capacity to enter into these Terms. The Services are intended for use in the United States unless otherwise stated. You are responsible for ensuring that your use complies with applicable laws.
Services; No Professional Advice
Tangelo Leads provides lead generation and sales facilitation services to home-services contractors, including solar, roofing, bath, and window contractors. Estimates, projections, lead volumes, timelines, and other information are for general informational purposes only and may be based on assumptions, third-party information, or limited inputs.
Tangelo Leads does not guarantee results, including sales, appointments, revenue, lead volume, lead quality, or any particular return on investment. You should consult qualified professionals regarding your specific circumstances.
User Submissions; Accuracy of Information
You agree to provide accurate, current, and complete information when requested and to update information as necessary. You are solely responsible for the accuracy of information submitted through the Services, including contact information, business details, and consent preferences. You authorize Tangelo Leads to rely on submitted information when providing Services.
Orders and Agreements
Pricing is provided on request. Each order is covered by an insertion order and a written agreement between you and Tangelo Leads (together, the "Order Documents"). The Order Documents set out the lead criteria, volume, delivery method, pricing, payment terms, and replacement and refund terms for that order. If these Terms conflict with the Order Documents, the Order Documents control for that order. Nothing on the Services is a binding offer until we both agree to the Order Documents. There is no long-term commitment or monthly retainer unless your Order Documents say otherwise, and each order stands on its own.
Payment
Payment terms are set out in your Order Documents. You agree to pay all amounts due under your Order Documents when they are due.
Delivery
We deliver leads by the method stated in your Order Documents, such as webhook, spreadsheet, or email. Delivery timing is an estimate and may vary. You are responsible for providing accurate delivery information and for keeping your systems available to receive leads.
Replacements and Refunds
Replacement and refund terms are set out in your Order Documents. If you have a concern about a lead, contact us promptly so we can review it. Only requests that meet the terms of your Order Documents will be eligible for a replacement or refund.
Your Responsibilities; Compliance with Laws
You are solely responsible for how you contact and market to the people in the leads you receive, and for complying with all laws that apply to you, including the Telephone Consumer Protection Act (TCPA), Do Not Call rules, CAN-SPAM, state telemarketing and privacy laws, and rules for contractor licensing and advertising. You agree to use leads only for lawful purposes, to honor opt-out and do-not-contact requests, and not to resell or transfer leads except as permitted in your Order Documents.
Communications Consent; Telephone, SMS, and Email
By submitting your information through the Services, you authorize Tangelo Leads to respond to your inquiry or provide information about services you requested using the contact details you provide. If you separately opt in to SMS/MMS communications by selecting one or both optional consent checkboxes on our forms, you consent to receive the categories of messages you selected from Horizon Solar Group LLC dba Tangelo Leads at the number you provide. Consent is not a condition of purchasing goods or services.
Mobile Messaging Terms
If you opt in to SMS/MMS messages through our forms, you consent to text messages at the number you provide in accordance with the selections you make. Message frequency may vary. Message and data rates may apply. Reply HELP for help or STOP to opt out. After opting out, you may receive one confirmation message unless you opt in again.
Do-Not-Call; Consent Regardless of Registry Status
To the extent permitted by law, any consent you provide through our forms may apply even if your number appears on federal, state, or internal do-not-call lists. Where required by law, Tangelo Leads honors applicable opt-out requests and revocations of consent.
Privacy Policy
Your use of the Services is also subject to Tangelo Leads' Privacy Policy, incorporated by reference.
Intellectual Property
All content available through the Services is owned by or licensed to Tangelo Leads and is protected by intellectual property laws. Unauthorized use is prohibited.
Acceptable Use
You agree not to use the Services in any unlawful, harmful, fraudulent, deceptive, or disruptive manner, or in any way that interferes with operation or security.
Third-Party Links
The Services may include links to third-party websites. Tangelo Leads is not responsible for their content or practices.
Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANGELO LEADS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES.
To the extent permitted by law, Tangelo Leads' total liability for any claim arising out of or relating to the Services is limited to the amount you paid Tangelo Leads for the order giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Tangelo Leads from claims arising out of your use of the Services or violation of these Terms, including claims arising out of your use of leads, your contact with or marketing to consumers, or your violation of any law or of your Order Documents.
Termination
Tangelo Leads may suspend or terminate access to the Services at any time in its discretion.
Governing Law
These Terms are governed by and construed under the laws of the State of California, without regard to conflict-of-law principles.
Changes to Terms
Tangelo Leads may modify these Terms at any time. Continued use constitutes acceptance of revised Terms.
Severability and Entire Agreement
If any provision is held unenforceable, remaining provisions remain in effect. These Terms, together with any applicable Order Documents, constitute the entire agreement regarding the Services.
